Terms of Service

The terms on which the official websites and digital services of the State may be used.

Definitions and Interpretation

In these Terms of Service, unless the context requires otherwise:

“Kaharagia” or “the State” means the State of the Kaharagians, its institutions, offices and competent authorities acting under lawful authority.

“Official Kaharagian Website” means any website, subdomain, online portal, digital publication or internet-based service operated by or on behalf of the State of the Kaharagians or one of its institutions.

“Service” means any website, portal, application, publication, communication system or other digital facility made available through an Official Kaharagian Website.

“User” means any natural or legal person who accesses or uses an Official Kaharagian Website or Service.

“Royal Kaharagian Gazette” means the official publication of record for Kaharagian laws, decrees, orders, notices and other instruments required to be officially published.

“Terms” means these Terms of Service, including any amendments made from time to time.

References to the singular include the plural where appropriate, and references to a website include any associated pages, sections, systems and services unless stated otherwise.

Application of These Terms

These Terms apply generally to Official Kaharagian Websites and Services.

A particular website or Service may publish additional or service-specific terms. Where additional terms apply, they form part of the conditions governing the use of that website or Service.

Where there is a conflict between these Terms and valid service-specific terms, the service-specific terms shall apply to the extent of that conflict.

These Terms operate subject to the Fundamental Laws, the Civil Code, the Data Protection Code and any other applicable Kaharagian law. They do not exclude or reduce a right or remedy conferred by a higher or mandatory rule of law.

Nature and Purpose of Official Kaharagian Websites

Official Kaharagian Websites exist to provide information about Kaharagia, its institutions, public activities, laws, programmes and services.

They may also be used to:

  • publish official information and public notices;
  • provide access to State programmes and digital services;
  • maintain public records and reference materials;
  • receive enquiries and applications;
  • provide accounts, portals and administrative functions;
  • publish educational, cultural or historical material; and
  • support the lawful functions of Kaharagian institutions.

Some websites are provided solely for informational purposes. Others may allow Users to submit information, create accounts, complete applications, communicate with State institutions or carry out other transactions.

The nature and purpose of each Service will be stated on the relevant website where necessary.

Acceptance of These Terms

These Terms state the conditions on which Official Kaharagian Websites and Services are offered. A contract is formed only when the User communicates unqualified acceptance and that acceptance reaches the State, in accordance with CC Arts. 43 and 44.

Acceptance may be recorded by selecting an acceptance control, signing electronically, creating an account after the Terms have been presented, or completing another process that clearly requires agreement. Mere access to publicly available information does not, by itself, establish contractual acceptance or voluntary submission to Kaharagian jurisdiction.

Where a Service requires an account, application or transaction, the User may be required to accept these Terms and any service-specific terms before continuing. A User who does not accept the applicable terms must not use the functions for which acceptance is required.

Governing Law, Jurisdiction and Enforcement

Where a valid contract is formed, the parties choose Kaharagian law to govern it, as permitted by FN Art. 45(3). These Terms remain subject to the Fundamental Laws, applicable promulgated treaties and Kaharagian conflict-of-laws rules. Mandatory host-jurisdiction law applies where Kaharagian law so provides.

A non-national submits to Kaharagian jurisdiction only where submission is evidenced in writing or another durable and verifiable form, and only to the extent stated, in accordance with FN Art. 44. Submission under service-specific terms does not create Kaharagian nationality or relieve any person from mandatory law in the place where they are present.

Acting through a competent authority and as permitted by applicable law, the State may choose to commence, defend, support or participate in proceedings; seek interim or final relief; enforce rights or judgments; cooperate with foreign authorities; or refer conduct to a competent authority in any jurisdiction. A choice to act in a foreign forum is limited to that matter and carries the jurisdictional consequences imposed by applicable law; it is not a general submission for unrelated matters.

Foreign servers, registrars, cloud providers and networks do not, by themselves, alter the official character or internal authority of a Kaharagian institution. This section is to be read with FN Arts. 6, 36, 38, 42, 45 and 47. Officials acting abroad do not claim immunity or privilege that the host jurisdiction does not recognise.

Permitted Use

Official Kaharagian Websites and Services may be used for their stated and lawful purposes.

Subject to these Terms and any service-specific conditions, Users may:

  • read and access publicly available material;
  • share links to publicly available content;
  • quote reasonable portions of published material with proper acknowledgement;
  • use authorised forms, portals and communication channels;
  • submit genuine enquiries, applications and requests;
  • access records or services for which they are properly authorised; and
  • use published material in accordance with the Crown Copyright and Re-use Policy.

Access to a website does not grant access to restricted systems, records, accounts or information.

Prohibited Conduct

Users must not use an Official Kaharagian Website or Service to engage in unlawful, fraudulent, abusive or disruptive conduct.

Users must not, whether directly or through another person, device, programme or automated system:

  • submit false, fraudulent, malicious, defamatory or unlawful material;
  • impersonate the State, the Sovereign, a Kaharagian institution, an official or another person;
  • falsely represent that they hold an office, appointment, title, rank, status or authority;
  • attempt to gain unauthorised access to an account, system, database, network or non-public area;
  • obtain or attempt to obtain information that they are not authorised to receive;
  • interfere with, damage or disrupt the operation or security of a website or Service;
  • introduce viruses, malicious code or other harmful material;
  • bypass security, access-control or rate-limiting measures;
  • scrape, harvest, copy or extract content or data at scale without permission;
  • collect personal information about other Users without lawful authority;
  • use a Service to harass, threaten, intimidate or harm another person;
  • submit excessive, repetitive or automated requests intended to interfere with normal operation;
  • alter, conceal or misrepresent the origin of a communication;
  • use official material in a manner that falsely suggests endorsement, recognition or approval; or
  • use a website or Service for any purpose prohibited by Kaharagian law or by the law applicable to the User.

The State may take technical, administrative or legal measures in response to prohibited conduct.

User Accounts

Some Services may require a User to create or use an authorised account.

Users are responsible for:

  • providing accurate and current information;
  • maintaining the confidentiality of their account credentials;
  • taking reasonable steps to prevent unauthorised access;
  • using their account only for its authorised purpose; and
  • notifying the relevant authority if they believe their account has been compromised.

A User must not allow another person to use an account where the account is intended for individual use.

The State may require additional identity checks, authentication measures or supporting documents where necessary to protect the integrity of a Service.

User Submissions

Where a Service allows Users to submit information, documents, messages or other material, the User remains responsible for the accuracy, lawfulness and appropriateness of that submission.

By submitting material, the User confirms that:

  • the information provided is accurate to the best of their knowledge;
  • they are authorised to provide it;
  • it does not unlawfully infringe the rights of another person;
  • it does not contain malicious or harmful material; and
  • the State may process it for the purpose for which it was submitted.

Submission of a form, message or application does not guarantee acceptance, approval, registration or any other particular outcome.

The State may reject, return, remove or disregard incomplete, inappropriate, fraudulent or unauthorised submissions.

Authoritative Status of Published Material

Material published on an Official Kaharagian Website may include summaries, explanations, guidance, reproductions and reference information.

Where a matter has legal effect under Kaharagian law, the authoritative source is the relevant law, decree, order, regulation, notice or other instrument as officially made and published.

Where publication in the Royal Kaharagian Gazette is required, the version published in the Gazette is authoritative.

If there is a discrepancy between:

  • an official instrument and a summary of that instrument;
  • a Gazette publication and a reproduction elsewhere;
  • an original record and a general information page; or
  • a current instrument and an older or archived version,

the authoritative and current instrument or record shall prevail.

Users should not rely upon summaries or explanatory material as a substitute for the official text.

Unless otherwise stated, material published across Official Kaharagian Websites is Crown Copyright and is issued under the authority of the State of the Kaharagians.

The reproduction and re-use of Crown Copyright material are governed by the Crown Copyright and Re-use Policy.

Nothing in these Terms grants a right to reproduce, imitate, register, commercially exploit or otherwise use:

  • official seals;
  • the Arms of Kaharagia;
  • State emblems;
  • royal symbols;
  • flags;
  • badges;
  • insignia;
  • official marks;
  • logos;
  • photographs;
  • commissioned artwork; or
  • other protected visual or identifying material.

Permission must be obtained from the Royal Chancellery where required.

Names, marks, emblems or symbols must not be used in a manner that suggests official status, endorsement, authorisation or association where none exists.

Third-Party Rights

Official Kaharagian Websites may contain material in which copyright, trade mark rights or other intellectual property rights belong to another person or organisation.

The inclusion of third-party material does not transfer ownership of that material to the State and does not grant Users permission to reproduce it.

Users are responsible for obtaining any permission required from the relevant rights holder.

Service Availability

Official Kaharagian Websites and Services are provided on an “as is” and “as available” basis.

The State does not guarantee that a website or Service will:

  • be continuously available;
  • operate without interruption;
  • be free from defects or errors;
  • remain compatible with every device or browser;
  • retain the same functions or appearance; or
  • be immune from technical failure, maintenance, cyber incidents or circumstances outside the State’s control.

The State may modify, suspend, restrict or discontinue any website, function or Service where necessary.

The State may also carry out maintenance, security work, data migration or system changes without prior notice where advance notice is not reasonably practicable.

Accuracy and Reliance

Reasonable efforts are made to keep official information accurate and current. However, information may become outdated, incomplete or temporarily incorrect.

Users should confirm important information through the appropriate official record or authority before relying upon it for legal, financial, administrative, commercial or other significant decisions.

General information published on a website does not constitute individual legal, financial, medical or professional advice.

Limitation of Liability

This section is subject to FN Art. 16, the effective-remedy guarantees in FN Arts. 32 and 35, the Civil Code and the compensation rights in DPC Art. 28. It does not exclude or restrict a claim, remedy or liability that Kaharagian law preserves.

To the fullest extent permitted by Kaharagian law, the State shall not be liable for loss or damage arising from:

  • temporary or permanent unavailability of a website or Service;
  • reliance upon general information or an unofficial summary;
  • the use or misuse of published material;
  • unauthorised access caused by a User’s failure to protect their account;
  • malicious software or harmful activity originating outside the State’s systems;
  • the conduct or content of a third-party website;
  • changes to, suspension of or discontinuance of a Service; or
  • circumstances beyond the reasonable control of the State.

The State shall not be liable for indirect, incidental, consequential, special, exemplary or punitive loss or damage except where such liability cannot lawfully be excluded.

Nothing in these Terms excludes liability for fraud or any other liability that may not be excluded under Kaharagian law.

Third-Party Websites and Services

Official Kaharagian Websites may contain links to websites, platforms or services operated by third parties.

Such links may be provided for reference, convenience or access to an external service. Their inclusion does not necessarily constitute approval, endorsement or acceptance of responsibility by the State.

The State is not responsible for:

  • the content of third-party websites;
  • their terms, policies or practices;
  • their availability or security;
  • transactions carried out through them; or
  • changes made to them after a link has been published.

Users should review the terms and privacy information of a third-party service before using it.

Data Protection and Privacy

Personal information submitted through an Official Kaharagian Website or Service will be handled in accordance with Kaharagian law and the privacy notice applicable to that website or Service.

Different Services may collect and process different categories of information according to their purpose.

Users should consult the relevant privacy notice for information about:

  • what information is collected;
  • why it is collected;
  • how it is used;
  • how long it is retained;
  • who may receive it; and
  • what rights or procedures apply.

Security

The State may use security measures including authentication, access controls, monitoring, logging, rate limiting, filtering and IP blocking to protect Official Kaharagian Websites and Services.

Users must not attempt to test, scan, probe or circumvent security measures without prior written authorisation.

Where a User becomes aware of a possible security vulnerability, the matter should be reported privately to the Royal Chancellery. Security concerns should not be publicly disclosed in a manner that could expose Users, systems or information to harm.

Restriction or Suspension of Access

The State may restrict, suspend or block access to an Official Kaharagian Website or Service where it reasonably believes that:

  • these Terms have been breached;
  • an account has been compromised;
  • access presents a security or operational risk;
  • a User has engaged in prohibited conduct;
  • information has been provided fraudulently;
  • access is required to be restricted by law or official order; or
  • restriction is necessary to protect the State, its institutions, its systems or another person.

Measures may include account suspension, account closure, rate limiting, IP blocking, removal of submitted material or referral to the appropriate authority.

Institutional Authority and Non-Waiver

Nothing in these Terms purports to fetter authority lawfully exercised under the Fundamental Laws. All State power remains subject to Kaharagian law, including the requirements of lawfulness, reasonableness, procedural fairness and effective review.

A failure or delay by the State to exercise a right, power or remedy shall not constitute a waiver of that right, power or remedy.

A waiver in one instance shall not be treated as a continuing waiver or as a waiver in any other instance.

Amendment and Revision

These Terms may be amended when necessary to reflect changes in Kaharagian law, constitutional practice, technology, security requirements or administrative policy.

Unless otherwise stated, amendments govern future use from the time the revised Terms are published. Publication alone does not retrospectively alter an existing contract.

Where an amendment materially changes an existing contractual relationship, notice and renewed acceptance will be obtained where required by the Civil Code or the applicable service-specific terms. Continued use constitutes acceptance only where the User was clearly informed of that consequence and the User’s conduct communicates unqualified assent.

The review date above will be updated after a substantive change.

Severability

If any provision of these Terms is found by a competent Kaharagian authority to be invalid, unlawful or unenforceable, that provision shall be limited, modified or removed only to the extent necessary.

The remaining provisions shall continue in full force and effect.

Entire Terms

These Terms, together with any applicable service-specific terms, privacy notices, the Crown Copyright and Re-use Policy and other expressly incorporated notices, form the terms governing the use of the relevant Official Kaharagian Website or Service.

Supplements for Particular Services

This policy applies to every official service of the State. Some services do something it does not describe, and publish a supplement saying so. A supplement is read together with this policy; it does not replace it.
